Terms of Service
Effective date: April 24, 2026
1. Who We Are
These Terms of Service ("Terms") govern your use of notary services provided by Andrea Fillingane, doing business as Andrea The Notary ("Andrea The Notary," "we," "our," or "us"), a sole proprietor commissioned notary public operating in the State of Colorado.
By booking an appointment, submitting a request, approving an estimate, or signing an agreement through any of our platforms (including andreathenotary.com and the client portal at portal.andreathenotary.com), you agree to these Terms.
2. Scope of Notary Services
Andrea The Notary provides notarial acts as authorized under Colorado law, including but not limited to: acknowledgments, jurats, oaths and affirmations, signature witnessing, copy certifications, and remote online notarization (RON) via a state-approved RON platform.
What notarization is not: A notary public is an impartial witness to the signing of documents. We do not provide legal advice, draft legal documents, or guarantee that a notarized document will be accepted by any court, government agency, or third party. If you need legal advice, please consult a licensed attorney.
We reserve the right to refuse any notarization at our sole discretion, including where the signer cannot satisfactorily establish their identity, appears to be acting under duress, or where notarizing the document would be unlawful.
3. Client Responsibilities
You agree that you will:
- Present a valid, government-issued photo identification acceptable under Colorado Revised Statutes § 24-21-507 at the time of notarization.
- Be of sound mind and willingly and voluntarily sign all documents presented for notarization.
- Provide accurate and complete information when booking appointments and submitting forms.
- Ensure that all documents to be notarized are complete (with the exception of your signature, which must be applied in the notary's presence) before the appointment.
- Notify us as soon as reasonably possible if you need to cancel or reschedule an appointment.
4. Fees and Payment
Notarial fees are set in accordance with Colorado law (C.R.S. § 24-21-519), which establishes a maximum fee of $15.00 per notarial act performed on paper and $25.00 per notarial act performed electronically or via remote online notarization (RON). All fees, including travel, printing, and any other applicable charges, will be itemized separately on your estimate or invoice as required by Colorado law.
Payment is due upon receipt of an invoice unless otherwise agreed in writing. We accept payment by credit or debit card (processed by Stripe). By providing payment information, you authorize Stripe to charge the amount shown.
Refunds: Because notarial acts are performed at the time of service, fees for completed notarizations are non-refundable. If an appointment is cancelled before any notarial act is performed, any prepaid fees will be refunded at our discretion. Travel fees may be charged for cancellations made after we have departed for a mobile appointment.
5. Electronic Signature Consent (ESIGN Act)
By signing service agreements, estimates, or other documents through our platform, you consent to the use of electronic signatures and electronic records in accordance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Colorado Uniform Electronic Transactions Act (C.R.S. § 24-71.3-101 et seq.).
Electronic signatures captured through our platform (whether typed or drawn) carry the same legal weight and effect as handwritten signatures. You have the right to receive a paper copy of any electronically signed document upon request. A copy of each signed document will be sent to the email address on file at the time of signing.
To use our electronic signature features, you must have access to a device capable of displaying and interacting with web-based content. You may withdraw your consent to electronic signatures at any time by contacting us, though withdrawal will not affect the validity of prior electronic signatures.
6. Notary Journal
As required by Colorado law (C.R.S. § 24-21-519), we maintain a secure, tamper-evident electronic journal of all notarial acts. Journal entries include information about each transaction and are retained for a minimum of ten (10) years. This journal is maintained for legal compliance purposes and may be subject to inspection as required by law.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Andrea The Notary's total liability for any claim arising out of or related to these Terms or our services shall not exceed the total fees paid by you for the specific notarial act giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages.
We are not responsible for the refusal of any third party (including courts, lenders, government agencies, or recording offices) to accept a notarized document.
8. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pueblo County, Colorado.
9. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted at this URL with a revised effective date. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
